1. Agreement to Terms

By accessing and using SocialAutoUpload ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

2. Description of Service

SocialAutoUpload is a social media management platform that allows users to:

• Connect and manage multiple social media accounts (Facebook, Instagram, YouTube, TikTok, Telegram)
• Create, schedule, and publish content across multiple platforms
• Organize channels into publishing profiles
• Use AI-powered tools for caption and hashtag generation
• Upload and manage media files
• Track posting history and activity logs
• Manage content templates and saved content

3. User Accounts

3.1 Account Creation

• You must be at least 13 years old to use this Service
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must not share your account credentials
• One person may only create one account

3.2 Account Security

• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• We are not liable for losses due to unauthorized account use
• Strong passwords are recommended

3.3 Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Abuse the Service or other users
• Remain inactive for extended periods

4. Social Media Account Connections

4.1 Authorization

By connecting your social media accounts, you authorize SocialAutoUpload to:

• Access your connected social media accounts
• Publish content on your behalf
• Retrieve account information (follower counts, page names, etc.)
• Store access tokens securely for ongoing access

4.2 Your Responsibilities

• You must own or have permission to manage the connected accounts
• You are responsible for all content published through our Service
• You must comply with each platform's terms of service
• You must ensure you have rights to any content you publish

4.3 Platform Compliance

You agree to comply with all terms of service and policies of:

• Facebook/Meta Terms of Service and Meta Platform Terms
• Instagram Terms of Use
• YouTube Terms of Service and YouTube API Services Terms
• TikTok Terms of Service and Community Guidelines
• Telegram Terms of Service

YouTube: SocialAutoUpload uses YouTube API Services. By using SocialAutoUpload's YouTube features, you are agreeing to be bound by the YouTube Terms of Service. Google's handling of your information is described in the Google Privacy Policy. You can revoke SocialAutoUpload's access to your YouTube data at any time via the Google security settings page.

5. Content Guidelines

5.1 Prohibited Content

You may NOT publish content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains hate speech, harassment, or discrimination
• Promotes violence or illegal activities
• Contains explicit sexual content (if not permitted by platform)
• Spreads misinformation or harmful false information
• Violates privacy rights of others
• Contains spam or unsolicited advertising

5.2 Content Ownership

• You retain all rights to content you create
• You grant us a limited license to process and publish your content
• We do not claim ownership of your content
• You are solely responsible for your content

5.3 Content Removal

We reserve the right to remove content that:

• Violates these Terms
• Violates platform policies
• Is reported by other users
• We deem inappropriate or harmful

6. Acceptable Use

6.1 You Agree NOT To:

• Use the Service for any illegal purposes
• Attempt to hack, disrupt, or damage the Service
• Reverse engineer or copy our software
• Use automated tools (bots) to abuse the Service
• Spam or mass-post inappropriate content
• Impersonate others or create fake accounts
• Collect user data without permission
• Resell or redistribute our Service
• Bypass any security measures
• Overload our servers with excessive requests

6.2 Rate Limits

We may impose rate limits to ensure fair use:

• Maximum posts per day: Subject to platform limits
• API request limits: As determined by us
• Upload limits: 500MB per file, total storage limits may apply

7. AI-Generated Content

7.1 AI Features

Our Service uses OpenAI, Google Gemini, and DeepSeek APIs for:

• Caption generation
• Hashtag suggestions
• Content optimization

8. Payment and Fees

8.1 Free Plan

We offer a Free plan with a monthly allowance of publish credits and upload transfer. The Free plan remains free; allowances may be adjusted with notice.

8.2 Paid Plans

We offer paid subscription plans (Creator, Pro, Agency, and Team) with larger monthly allowances and additional features. For paid plans:

• Current pricing is clearly displayed on our Pricing page
• Plans are billed monthly (annual billing is available on request); payment is arranged directly with us via Telegram or WhatsApp
• You will be notified at least 30 days before any price increase to your active plan
• If a paid plan is cancelled or expires, your account moves to the Free plan — your account and content are not deleted
• Refunds for unused full months are handled case-by-case — contact support

8.3 Third-Party Costs

You are responsible for:

• Internet connection fees
• Costs associated with connected social media platforms
• Any fees charged by third-party services you use

9. Service Availability

9.1 Service Uptime

We strive to maintain high availability but do not guarantee:

• 100% uptime or uninterrupted access
• Error-free operation
• Compatibility with all devices/browsers

9.2 Maintenance

• We may perform scheduled maintenance
• We will notify users of major maintenance when possible
• Emergency maintenance may occur without notice

9.3 Service Changes

We reserve the right to:

• Modify or discontinue features
• Update the Service
• Change system requirements
• Introduce new features

10. Intellectual Property

10.1 Our Property

SocialAutoUpload and all related materials are our property:

• Source code and software
• Design, UI/UX, and branding
• Logos, trademarks, and service marks
• Documentation and tutorials

10.2 Your Property

• You retain all rights to your content
• You retain rights to your media files
• We do not claim ownership of user-generated content

10.3 License Grant

You grant us a limited, non-exclusive license to:

• Store and process your content
• Publish content to your connected platforms
• Display content in your account interface
• Back up your content for service continuity

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

12. Disclaimers and Limitations

12.3 No Guarantees

We do not guarantee:

• Successful publishing to all platforms
• Specific engagement or reach on posts
• Account growth or follower increases
• Accuracy of AI-generated content
• Compatibility with all social media features

13. Limitation of Liability

This includes but is not limited to:

• Lost content or data
• Failed posts or scheduling errors
• Account suspensions on connected platforms
• Damages from service interruptions
• Third-party actions or platform changes

14. Indemnification

You agree to indemnify and hold SocialAutoUpload harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your content and publications
• Your violation of these Terms
• Your violation of third-party rights
• Your violation of platform policies

15. Termination

15.1 By You

• You may delete your account at any time
• You can request data deletion
• Data will be deleted within 30 days

15.2 By Us

We may terminate or suspend your account if:

• You violate these Terms
• We are required to by law
• Your account has been inactive for 2+ years
• You engage in fraudulent or harmful activities

15.3 Effect of Termination

• Access to the Service will be revoked
• Content will be deleted per our data retention policy
• You remain liable for any outstanding obligations

16. Dispute Resolution

16.1 Governing Law

These Terms shall be governed by the laws of Thailand.

16.2 Arbitration

Any disputes shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in Thailand.

16.3 No Class Actions

You agree to resolve disputes individually, not as part of a class action.

17. Changes to Terms

We may modify these Terms at any time. Changes will be effective:

• Upon posting updated Terms on this page
• After 30 days notice for material changes

Continued use after changes constitutes acceptance of new Terms.
